Surrogacy, Italy condemned
"Violated child's right to family and private life"
Italy violated the rights of a baby girl born in 2019 in Ukraine through surrogacy, preventing legal recognition of her filiation relationship with her biological father and making her stateless. This was ruled by the European Court of Human Rights.
For the Court, the Italian State violated the child's right to family and private life. Italy will have to pay 15,000 euro for moral damages to the child and a further 9,536 euro for legal costs incurred by the biological father and the intended mother.
